Work Together

THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, AND ALSO LIMIT THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE.

Eligibility to Use the Services

1. To access or use the services, you must be at least 18 years of age or the age of majority in your jurisdiction, if older, and not prohibited from doing so by applicable law. Unless otherwise approved by us or as set forth below, the services are intended for your personal, non-commercial use. If you wish to use the services for commercial purposes, you must enter into a separate agreement with us. You may not use the services if your account(s) have been terminated by us or if you have been banned.

Together Services Accounts

2.1 Accounts and Profiles

2 To access most of our services, you must create an account and provide email or phone number.

By creating an account, you agree that the information you provide to us is accurate, and you will keep it accurate and up-to-date at all times. It is your responsibility to safeguard your account(s), and you accept liability for any activities that occur through your account(s). Together disclaims any liability for actions made by third parties using your account(s). If you suspect any unauthorized use of your account(s) or access to your password(s), you agree to notify us immediately.

To provide you with access to features across our services, we create and link different anonymous accounts for you.

When you set up an account to access the services, a Profile will be created for you, which includes the professional data you provide. Our Privacy Policy provides more information about how we collect and process your data.

We may attempt to verify your employment or status through various methods, including third-party integrations or services, as well as signals received from your current or former employer.

Certain portions of your Profile may be visible to other users and the public, such as your Anon name, depending on the services you use. However, your Profile will not publicly include or link to Your Content (as defined in section 3), which you submit anonymously to our services. For more information about your anonymity options, please refer to section 4 of these Terms and our Privacy Policy.

3.1 Rights to Your Content

You are solely responsible for your use of the services and any content you authorize for use on the services or submit via your account ("Your Content"). We do not claim ownership of Your Content that you submit or authorize for use on the services, but by submitting or authorizing us to display Your Content, you grant us the following rights. You hereby grant us a worldwide, unrestricted, irrevocable, perpetual, non-exclusive, fully-paid, and royalty-free license (with the right to sublicense through unlimited levels of sublicenses) to use, reproduce, copy, process, modify, publish, translate, transmit, perform, display, create derivative works of, adapt, and distribute Your Content in any and all media (now known or later developed) throughout the world. This license includes the right to display your name, images, likeness, voice, video, and any other content you submit, link, or make available through the services, for purposes of promoting our services, both on and off the services. To the extent permitted by applicable law, you expressly waive any and all moral rights you may have in relation to together's exercise of this license. You agree that this license also allows us to provide, promote, and improve the services, as well as make the content you submit available to other companies, organizations, or individuals for syndication, broadcast, distribution, promotion, or publication on other media and services, subject to our terms and conditions for such content use. No compensation will be paid to you for the content you submit through the services. Please note that some live audio/video events hosted on or through the services may be recorded. By using the services and attending/participating in such audio/video events, you agree to the recording of these events and acknowledge that all rights, titles, and interests in such recordings will vest in together. You should only submit content to the services that you are comfortable sharing with others under these Terms. By submitting ideas, suggestions, documents, feedback, and/or proposals (collectively, "Submissions") to Together, its employees, or agents, you acknowledge and agree that Together is entitled to use, disclose, reproduce, license, and distribute these Submissions as we see fit, without any obligation or restriction of any kind concerning intellectual property rights or otherwise.

3.2 Your Limited Rights to Content

The services include content provided by us. We, including other users, own and retain all proprietary and intellectual property rights in the respective content provided. Together owns and retains all rights in the services. If you are an authorized user, we grant you a limited, revocable, non-transferable, non-sublicensable license under the rights licensable by us to use the services and the content from our services solely for your personal use in connection with the services. However, except as provided in this section, you agree not to: Reproduce, modify, publish, transmit, distribute, publicly perform or display, sell, adapt, or create derivative works based on the services or the content (excluding Your Content). Rent, lease, loan, or sell access to the services. The trademarks, logos, and service marks ("Marks") displayed on the services are our property or the property of third parties. You are not permitted to use these Marks without our prior written consent or the consent of the third party that owns the Mark. Together reserves all rights not expressly granted in these Terms.

3.3 Content on the Services

The services provide you with access to content from Together, users, advertisers, and other third parties. It is important for you to understand and agree to the following: The Services may contain or have links to sponsored third-party content or advertisements. The type, extent, and targeting of ads may change, and you acknowledge and agree that we may display ads in connection with the presentation of any content or information on the services, including Your Content. We are not responsible for and do not endorse any third-party content, including linked content, advertisements, information about third-party products and services, job ads, employer and salary-related information provided by others, or the opinions of any third party, including panelists, group leaders, or other users involved in audio or video events, or translations, transcriptions, or captions of any content. We do not guarantee the accuracy, currency, suitability, reliability, or quality of the information or content on the services or linked through our services, including translations, transcriptions, or captions. We assume no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content made available by users, advertisers, and third parties. It is important to exercise your own judgment and discretion when accessing and relying on any content available on the services.

4.1 Together Anonymity and Identity

Semi-Anonymous Content

When you submit content such as a post, comment, or question, you may be able to control how you represent yourself using different anonymity options. For example, you can choose to submit content with your company name, job title, or full name.

Required Personal Data

When submitting other content, such as reviews, you may be required to include certain personal data for public display, such as your employer, job title, and/or location.

Group Leaders

In some instances, group leaders may be able to limit access to a group and approve new group members. When you request access to a group, your profile and answers to member-approval questions may be shared with the leader(s) for that group.

Anonymity Guarantee

Together endeavors to offer opportunities to use its services while preserving your anonymity. However, you acknowledge that Together cannot guarantee your anonymity. Depending on your specific situation and circumstances, even semi-anonymous identifiers, such as the company or job title, especially when paired with other information such as your location, may allow someone to identify you or narrow down your identity to a small group of people. You should understand this risk before submitting content to the services.

Tips for Maintaining Anonymity

If you are concerned about your anonymity, there are a few things you can do to reduce the risk of being identified:

  • Do not include any personal information in your content that could be used to identify you, such as your full name, home address, or phone number.
  • Use a pseudonym or a nickname instead of your real name.
  • Use a secure, anonymous email address when creating your Together account.
  • Be careful about what information you share in your profile. Do not include any information that could be used to identify you, such as your current or previous employers, your job title, or your location.

By following these tips, you can help to protect your anonymity while using Together.

4.1 House Rules

When using the services, you agree to comply with these Terms and all applicable laws, regulations, and contractual obligations. Your use of the services and Your Content is your sole responsibility. By submitting or authorizing Your Content for use on the services, you acknowledge that you have reviewed, understood, and agreed to abide by our Community Guidelines, which include the Together Community Guidelines and Together Community Guidelines and are incorporated into these Terms. You understand that if Your Content or your use of the services violates any applicable law or infringes upon any third-party rights, you may be held liable. If you are associated with a multi-level marketing company, you must review and adhere to the Together Guidelines for Multi-Level Marketing Companies. If you choose to conduct a Promotion using the services, such as a contest or sweepstakes, you are solely responsible for ensuring compliance with all relevant laws and regulations. You must clearly state that the Promotion is not sponsored, endorsed, or associated with Together or our services. We do not provide assistance with Promotions, and you conduct them at your own risk. We reserve the right to restrict your use of the services for conducting Promotions. We allow users to submit Content about their work experiences with employers, including full-time, part-time, contract, freelance, and independent roles that are integral to the employer's value chain. Content about the staffing firms that place users in these roles is also permitted. All workers in these roles are considered "employees" for the purpose of submitting Content to Together services. While specifying the employment category is optional, workers in these roles can submit Content as "employees" without violating our Community Guidelines or these Terms. You agree not to: Impersonate others or misrepresent your affiliation with an employer. Create accounts under false pretenses or for anyone other than yourself, or create multiple active accounts to submit Content or interact with other users. Submit Content that you do not own or have the right to submit under the license granted in these Terms. Violate these Terms, your agreements with us, the explicit restrictions in our Community Guidelines, or any applicable law, rule, or regulation. Submit defamatory, fraudulent, false, or misleading Content that does not reflect your honest opinion and authentic experience. Engage in harassing, trolling, threatening, abusive, racist, bigoted, or objectionable behavior as determined by Together. Discriminate regarding access to communities or groups. Promote or endorse illegal activities. Disclose confidential information in violation of contractual obligations or the rights of any third party. Violate the intellectual property or proprietary rights of any third party. Submit pornographic or sexually explicit content or exploit individuals in a sexual or violent manner. Solicit or submit personal data of minors. Use the services for commercial activities or promotions without our approval, except as permitted by applicable laws. Imply Together's endorsement, sponsorship, or partnership without our written permission. Send messages in violation of anti-spam laws. Introduce software or automated agents without permission, or scrape data from the services. Incorporate part of the services into another website without permission. Copy, modify, or create derivative works of the services or Content (excluding Your Content) without permission. Use the services in connection with a competitive service. Violate antitrust laws or engage in anticompetitive conduct. Monetize access to the services or Content (excluding Your Content) without permission. Interfere with the functionality or security of the services. Introduce malicious software or attempt to circumvent security features of the services.

Together Content Removal and Enforcement

Together has the right to review and remove any content that it believes violates its terms of service or community guidelines. If you see any content that you believe violates the terms of service, you can report it by clicking on the "Report" button next to the content. Together will review the content and take appropriate action, which may include removing the content or taking action against the user who posted the content.

Copyright Policy

Together respects the intellectual property rights of others. If you believe that your copyrighted work has been infringed on Together, you can submit a copyright complaint by emailing us on support@worktogether.io. Together will review your complaint and take appropriate action, which may include removing the infringing content.

Other Enforcement Actions

In addition to removing content, Together may also take other enforcement actions against users who violate the terms of service. These actions may include suspending or terminating a user's account, reporting the user to law enforcement, or taking legal action against the user.

Disclosing User Personal Data

Together may disclose user personal data to third parties in certain circumstances, such as when required to do so by law or valid legal process. Together will also take appropriate action to protect the anonymity of its users against the enforcement of subpoenas or other information requests that seek a user's identifying information or personal data.

Indemnity

You agree to indemnify and hold Together and its affiliates, subsidiaries, officers, directors, employees, agents, and representatives harmless from any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the services, including your breach of any provision of the terms of service.

Disclaimers and Limitation of Liability

Together disclaims all warranties, express or implied, with respect to the services, including but not limited to the accuracy, completeness, legality, reliability, and availability of any information, content, or materials provided on or through the services. Together is not responsible for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communications line failures, theft or destruction or unauthorized access to, or alteration of, any information, content, or materials. Together is also not responsible for any problems or technical malfunction of any hardware or software due to technical problems on the Internet or on the services or combination thereof.

In no event shall Together be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for lost profits, loss of use, or loss of data, arising out of or in connection with the services, whether based on a theory of contract, tort, negligence, strict liability, or otherwise, even if Together has been advised of the possibility of such damages.

Termination

These Terms will remain in effect for the duration of your use of the services and, for registered users, as long as your account(s) remain open. You have the option to delete your account(s) at any time. We reserve the right to suspend or terminate your account(s) or restrict your access to certain parts of the services, without providing notice or stating a reason. We will not be liable to you in any way for the termination of your account(s) or the deletion of your data. All provisions of these Terms will continue to be valid even after the termination or expiration of these Terms, except for provisions that grant access to or use of the services. It is important to note that these Terms will apply to your use of the services and any content you submit on the services, regardless of whether it occurred before or after the termination or expiration of these Terms. Changes to These Terms We reserve the right to modify these Terms occasionally by posting an updated version accessible through a link on the services. If we make changes that we believe significantly diminish your rights or increase your responsibilities, we will notify you through communication channels such as email or text message, using the email address or phone number provided in your account, or by posting a notice on the services before the changes take effect. We may also provide notice of changes in other circumstances. Any changes made will not apply to any claims made prior to the effective date of the revised Terms that incorporate such changes.
